June 28, 2012 -- NEW YORK, NY -- Gotham Tea Party, Inc., a tea party organization formed to develop and support winning campaigns, expresses grave concern for Americans' personal and economic liberty in the wake of the Supreme Court's earth-shattering 5-4 majority opinion upholding the coercive, extortionate individual mandate-as-tax provision of the Patient Protection and Affordable Care Act ("PPACA") -- known popularly as "ObamaCare." (The case citation is NFIB v. Sebelius.)
The implications of today's decision are extreme. The Supreme Court's divided opinion permits the federal government to use its taxation power to impose a mandate, as long as it is in the form of a tax. This allows the federal government to implement the dangerous Section 1501 of the PPACA that compels people to buy health insurance or face a financial penalty, and promote the dangerous principle that the federal government can force you to pay for something because the government determines for you that you need it, even if you ultimately do not use it. Now, there is no limit -- other than Congressional repeal -- on the federal government's power to coerce private citizens to enter into contracts with private organizations and give those organizations your money, or face financial penalties. A coercive choice among undesirable options, to pay for insurance or pay a penalty, is hardly freedom. The difference between an outright mandate -- revealing our true loss of liberty -- and a virtually extortionate choice is merely one of semantics.
The federal government now becomes an all-powerful central government with plenary power over every area and aspect of your life from cradle to grave. Unless something is protected by a specific provision in the Bill of Rights (such as free speech or the right to own a gun), the federal government can now control it...and attempt to chip away at these remaining rights. President Obama's ominous vow to "fundamentally transform the United States of America" now may become a cruel reality.
Gotham Tea Party believes that Congressional repeal is essential to protect Americans' liberty and economic freedom in the wake of this decision. Gotham Tea Party urges the American people to protest this decision's dangerously transformative effects upon our entire way of life, and become extremely active in electoral affairs and the November 2012 election in particular.
